Many Veterans Avoid Addiction Treatment for Fear of Losing Their Guns

A significant number of military veterans are avoiding seeking VA treatment for substance use disorders and PTSD because the VA can then declare them mentally incompetent, which can prevent them from buying or owning a gun.

The VA is allowed to declare veterans incompetent in order to send their financial benefits to a guardian or other fiduciary. However, such a designation also enters the veteran’s name into the National Instant Criminal Background Check System, which can result in their not being allowed to have a firearm.

Nearly half of all veterans own guns, and the NRA has complained that the system unfairly affects gun rights, often without the veteran even being informed in advance that his or her rights will be affected.
